Terms and Conditions

1. Scope
These Terms and Conditions apply to all orders placed via our online shop by consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes not predominantly related to commercial or self-employed professional activity.
A business is any natural or legal person acting in the course of their commercial or independent professional activity.
Conflicting or additional terms of businesses shall not apply unless expressly agreed.
 
2. Contractual Partner, Conclusion of Contract
The contract is concluded with:

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the “Place Order” button, the customer submits a binding offer.
The contract is concluded upon order confirmation or provision of the service.
Access to online trainings is granted from the date of payment and remains valid indefinitely or as long as the shop exists.
 
3. Contract Language and Storage
The contract language is German and English.
The contract text is stored and accessible via the customer account.
 
4. User Account
The user account may only be used by the registered person.
Sharing login credentials with third parties is prohibited.
Suspicious usage patterns may result in immediate suspension without refund.
 
5. Payments
Available payment methods:
• PayPal
• Bank transfer
• PayPal direct debit
Orders from non-EU countries are invoiced without VAT.
EU customers with a valid VAT ID (excluding Germany) are invoiced tax-free.
 
6. Right of Withdrawal
Consumers have a statutory right of withdrawal.
For digital content, the right of withdrawal expires once performance has begun with the customer’s consent.
 
7. Intellectual Property
All content is the intellectual property of the provider.
Reproduction or distribution without permission is prohibited.
 
8. Applicable Law and Jurisdiction
German law applies.
For businesses, the place of jurisdiction is the provider’s registered office.
For consumers, statutory jurisdiction rules apply.

 

ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)

1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen, die über unseren Online-Shop abgeschlossen werden, sowohl durch Verbraucher als auch durch Unternehmer.
Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
Unternehmer ist eine natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
Abweichende oder ergänzende Allgemeine Geschäftsbedingungen von Unternehmern werden nicht Vertragsbestandteil, es sei denn, wir stimmen ihrer Geltung ausdrücklich zu.
 
2. Vertragspartner, Vertragsschluss
Der Kaufvertrag kommt zustande mit:

Die Präsentation der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine unverbindliche Aufforderung zur Abgabe einer Bestellung dar.
Durch Anklicken des Buttons „Jetzt kaufen / Bestellung absenden“ gibt der Kunde ein verbindliches Angebot zum Abschluss eines Kaufvertrages ab.
Der Vertrag kommt zustande, sobald wir die Bestellung per E-Mail bestätigen oder die Leistung erbringen.
Der Zugang zu Online-Trainings wird ab dem Tag des Zahlungseingangs gewährt und gilt zeitlich unbegrenzt bzw. solange der Online-Shop besteht.
 
3. Vertragssprache, Vertragstextspeicherung
Die Vertragssprache ist Deutsch und Englisch.
Der Vertragstext wird gespeichert und ist für den Kunden über sein Benutzerkonto zugänglich.
 
4. Nutzerkonto
Das Benutzerkonto darf ausschließlich von der registrierten Person genutzt werden.
Die Weitergabe von Zugangsdaten an Dritte ist untersagt.
Bei auffälligen Login-Mustern (z. B. Nutzung von mehreren Geräten oder Standorten in kurzer Zeit) behalten wir uns vor:
• den Zugang sofort zu sperren,
• das Nutzerkonto dauerhaft zu deaktivieren,
• ohne Anspruch auf Rückerstattung.
4.2 Nutzung der Inhalte – Trainer & Ausbilder
Die erworbenen Inhalte dürfen ausschließlich für die eigene berufliche Tätigkeit genutzt werden.
Eine Weitergabe, Vervielfältigung, Veröffentlichung oder Nutzung zu Schulungszwecken ist untersagt, insbesondere:
• bei Weitergabe an Mitarbeiter,
• bei Nutzung in Workshops, Webinaren oder Social Media.
Bei Verstoß behalten wir uns rechtliche Schritte sowie die sofortige Sperrung des Zugangs vor.
 
5. Zahlungsbedingungen
Folgende Zahlungsmethoden stehen zur Verfügung:
• PayPal
• Banküberweisung
• PayPal-Lastschrift
Bei Lieferungen in Länder außerhalb der EU erfolgt die Rechnungsstellung ohne Mehrwertsteuer.
Bei Vorliegen einer gültigen EU-Umsatzsteuer-ID (außer Deutschland) erfolgt ebenfalls eine steuerfreie Lieferung.
 
6. Widerrufsrecht
Verbrauchern steht das gesetzliche Widerrufsrecht zu.
Bei digitalen Inhalten erlischt das Widerrufsrecht, sobald mit der Ausführung des Vertrages begonnen wurde und der Kunde ausdrücklich zugestimmt hat.
 
7. Urheberrecht
Alle Inhalte unterliegen dem Urheberrecht des Anbieters.
Eine Vervielfältigung, Speicherung oder Verbreitung ist ohne ausdrückliche Zustimmung untersagt.
 
8. Anwendbares Recht, Gerichtsstand
Es gilt das Recht der Bundesrepublik Deutschland.
Für Unternehmer ist der Gerichtsstand der Sitz des Anbieters.
Für Verbraucher gelten die gesetzlichen Gerichtsstandsregelungen.

What do you need to be able to watch the Online Trainings?

Nothing extra. You have to be registered in our web shop, pay for the training, own a device where you can see the videos in big size (so we highly recommended minimum a tablet, or iPad), a fast internet, and a comfortable chair.

If you had choosen paypal payment, you don’t have to do anything, just go back on the button: My videos, and you can immediately enjoy your course.

In case of bank transfer, you can have the access to the trainings after the money arrived on our bank account. Then you get a confirmation letter in e-mail. After this e-mail, you can go back to the web shop, click on the My videos button and enjoy the video.

For all online classes with this endless replay availability, no refunds will be given once the online class has been bought.

If you are unable to watch the online trainings due to technical issues, please contact us for assistance.

So long these videos are only able to watch over our web shop, to avoid any kind of bans, keep in mind to log in from only one device, because the web shop automatically tracks your IP address. If there are any multiple logins appear, you will get banned automatically from our web shop.
